RHOBH Attorney Thomas Girardi to Plead the Fifth at Upcoming Contempt Hearing as Conservator is Ordered to Court to Turn Over His Financial Records

Thomas Girardi is refusing to answer questions about the whereabouts of the millions of dollars he’s accused of embezzling from his former clients.

During a court appearance on Monday, lawyers representing the estranged husband of The Real Housewives of Beverly Hills cast member Erika Jayne and his law firm bookkeeper, David Lira, revealed that both men would be invoking their Fifth Amendment right against self-incrimination at an upcoming contempt hearing.

On July 26, Radar Online confirmed Thomas and his law firm partners at Girardi Keese were found to be in contempt of court over the $2 million in missing settlement money due to family members of the victims of a 2018 plane crash in Indonesia.

According to Thomas’ attorney, he will be invoking his Fifth Amendment right due not only to his age of 82, but also his recent Alzheimer’s diagnosis, which has been called into question by many.

“I don’t believe he would sufficiently, at least for any lengthy period of time,” she explained.  “He does not recall one of my conversations with him between conversations.”

As for David, he previously claimed to be in the dark about the missing money.

After Thomas failed to turn over his former clients’ money, they filed a federal lawsuit against him with the help of Edelson PC, also including Erika as a defendant in the case. And, shortly thereafter, the lawsuit was referred for a possible criminal investigation.

According to a second Radar Online report shared on July 25, Robert Girardi, who has been named as Thomas’ permanent conservator, has been ordered to appear in court with Thomas’ financial books.

In the past, Robert has been accused of failing to show up to court to offer help amid the ongoing bankruptcy proceedings against Thomas, even though the trustee working on the case believes he’s in possession of critical information he believes will help move the bankruptcy forward and help him repay the many former clients and creditors Thomas is accused of ripping off.
